In New York the buyer hires a title search company and that comes with an insurance policy. If a situation arises such as yours the title insurance pays the bills. It would most likely cost you more in legal fees to sue the lawyer.
That is why people have title insurance. If their lawyer goofs, they pay. Since your lawyer goofed, you pay.
No, he is not responsible. Title insurnace is used for this, otherwise it is your problem.
He is not responsible for anything that did not show up, the entire reason title insurance exists.
You’ve asked the same question three times. I’ve already answered it once, and you’ve gotten other answers, too.
You have provided some additional information: No, I did not have title insurance because I had a lawyer searching the deed. Huh? And what protection does that provide you?
And why would the lawyer pay for the old judgments? He didn’t incur them. He didn’t buy the house. He wasn’t in the hospital (per your other posts.) If the lawyer screwed up, then you go after his EO (errors and omissions) policy.
Now you know why title insurance exists. You cannot sue the attorney for malpractice over these missed judgments. If you had wisely purchased title insurance (which you did not) you would have no issues, since the title insurance firm would cover all costs.
Now you’re on your own.
